Contra Costa County Superior Court Small Claims Mediation
Mediation on the Day of Trial
The Congress of Neutrals provides mediation services in small claims cases throughout Contra Costa County. Participation in these mediations, which are held on the day of trial in three of the local branch courts (Concord, Pittsburg, and Walnut Creek), is free of charge, voluntary and confidential. An Agreement to Mediate must be reviewed and signed by all persons present during the settlement meeting.
If the mediation is successful:
- A written Mediated Settlement Agreement is prepared, reviewed and signed, and copies are given to each disputant
- There is usually no need to go back into the courtroom if a settlement is reached

Telephone Mediation Before Trial
In 2009, we began a pilot program to provide litigants with the opportunity to participate in a telephone mediation on an agreed upon date prior to the date of trial. If all parties agree, the telephone mediation can be scheduled in advance of the hearing date at a time which is convenient to the parties and the mediator.
